Libel Case

I have been silent and off-line for a while. I am not unwell, but thanks for asking. There is a court case coming up in the High Court in London on the 3rd of July. I am suing the Mail on Sunday, along with Zoe Harcombe. This is complex and highly time-consuming case, and there are many sensitive issues on the line.

It was reported in the BMJ last year:

The controversy over the benefits of statins is set to be aired in the High Court in London, in what the senior libel judge has described as the “most significant piece of defamation litigation that I have seen in a very long time.”

Mr Justice Nicklin made the comment in a preliminary ruling in a libel action by Malcolm Kendrick, a GP, and Zoe Harcombe, a researcher, author, and blogger with a PhD in public health nutrition, against Associated Newspapers, publishers of the Mail on Sunday and Mail Online, over articles that labelled them “statin deniers” whose “deadly propaganda” had endangered lives.

In the judgment Nicklin ordered that the case should be heard in two tranches: a preliminary trial of certain issues, followed by a main trial. “It is no exaggeration to say that the parameters of this litigation are very substantial,” he said.

Kendrick and Harcombe are suing over articles published in the print edition of the Mail on Sunday and in Mail Online in March 2019. A news story in the paper was headlined “Statin deniers are putting patients at risk says Minister.”

Dr Zoë Harcombe and Dr Malcolm Kendrick have brought libel proceedings against both the publisher of The Mail on Sunday and the newspaper’s Health Editor, Barney Calman, over a series of articles first published in March 2019 in the news and health section. Dr Harcombe and Dr Kendrick complain that the Mail on Sunday made a series of libellous allegations, attacking their professional integrity with reference to their public statements and writings concerning the use and efficacy of statin therapy.    Due to the unusual complexity of the case, it has been split into two trials.  At a trial in July (Trial 1) , the court will decide, among other central issues, the meaning of the articles of which complaint is made, whether they were an expression of opinion by Mr Calman or a statement of fact and whether the defendants are entitled to rely on a public interest defence.  The court at Trial 1 will not have to determine the truth or otherwise of the published allegations, and the question of what the defendants have to prove to be true, and whether they can defend their statements as expressions of opinion will depend on the outcome of Trial 1. The focus is on what was said by Mr Calman about the claimants and whether that can be defended.

    We can no longer have a civilized conversation about anything without someone jumping up and calling us out as either liars or worse trying to destroy humanity. A doctor when asked about vitamins stated that drinking cow urine would be less damaging than taking Vitamin C I laughed so hard I missed whether this should be pasteurized cow urine or should we drink it fresh from the cow and the next question would be where could we buy this in Australia. This was some advice we received during COVID so much for education.

    Good for you. I’ve always liked you, and I’ve always liked Zoe. I do generally agree with both of you. But that’s not the point. We can all be wrong about things, and maybe both of you have been from time to time about this or that; but what I do know beyond a shadow of doubt from seeing what both of you have to say is that you’re sincerely trying to get at the truth and tell the truth. You should not be libelled for that.

    I wish you success in your libel action and hope you will continue to keep us ‘statin deniers’ up to date with the antics of the statin manufacturers and ‘pushers’. Many GPs seem only to believe the prevailing view of ‘cholesterol theory’ and I have noticed recent articles showing symptoms of supposed high cholesterol on feet.

    I am a 69 years old LADA diabetic, initially diagnosed as an ‘untypical’ type 2 ie not overweight etc. Doctors and nurses have been trying to push me to take statins since I was initially and wrongly diagnosed 13 years ago.

    I have recommended your book many times, and will continue to do so. I desparately hope that if you succeed in this libel action, it will be the beginning of the end of ‘The Great Cholesterol Con’.

    Hello,
    I am 72, my husband is 75. In the past 30 years we have watched what happens to “cardiology” patients. One friend has Parkinson’s ( nervous system) and another one has severe heart issues. At 50 these men were biking up the Canadian Rockies.. and now in their 70’s they are debilitated. None of this is “hereditary”. The common denominator here is 20 years of statins. It’s a travesty. 😫😡

Should be a lot of data made public knowledge during it, though of course there’s a problem that many people believe that statins save lives and will therefore not accept the evidence that they don’t. Much the same problem with the usefulness of masking against aerosol viruses.

    Calling someone a “denier” is an appeal to belief over data, and has subconscious links to Holocaust denial and rejection of things that are obviously true. Here, seems to me that the supporters of statins are in denial of the evidence against them. Also, of course, they are very profitable.

    Such a typical smear ‘denier’ from the Mail on Sunday, Mail on-line…..and other msm to denigrate an alternative and reputable source. Having read what Malcolm Kendrick has written about cholesterol and the role of statins, it is libellous to write he is a “statin denier”….and had “endangered lives”. I’d be furious. He has done extensive and very informative research on cholesterol and the role it plays in metabolic health. It is just one part of the equation ( cholesterol) and its impact varies from individual to individual. Thus, to address every instance in people of a raised level of LDL cholesterol with a stating regime, is the “one size fits all” approach. An approach promoted and advocated by Big Pharma…..after all such an approach must generate greater financial returns.

    My mum was made very ill by statins. After we told her about a Telegraph article (we had already read Dr Kendrick’s book)by Dr James Lefanu, she agreed to a ‘statin holiday’. Her recovery seemed miraculous. A friend, on statins, was falling, and we were sure she was getting dementia, gave them up of her own accord. She’s now much better with all her faculties at 91. It makes my blood boil. Go Dr Kendrick!

    I amongst many others are glad to hear from you Malcolm after what seems to be a considerable absence. I’m also pleased that your health is intact. Your mental state must be taking a battering in light of your impending court case; I suspect that the stress levels are all over the the place.

    I have followed you and other truth-bringers regarding cholesterol myths and all the associated tangents and I am completely convinced that your are 100% correct. ‘The Clot Thickens’ surely cannot be denied by the naysayers out there and must finally connect the dots for them. I have been ‘off’ my prescribed statins for over 20 years purely by acting on instinct and I’m surely not alone when you came along and lifted any guilt we may have felt. I have rigourously ‘debated’ and criticised the dogma with many a GP to no avail. You’ve mentioned it yourself: Medical professionals cannot afford to challenge the Holy Grails of statins, ( and vaccines)….or words to that effect.

    Without being a touch premature, I sincerely congratulate your intended actions within our judicial sysems. I wouldn’t wish to predict the outcome but I would be perfectly willing to recognise where the justice SHOULD be applied.

    Thank you so much for having the bravery to confront this huge endeavour: I’m kind of hoping that fighting a libel action against a newspaper might just be the first loosening stone in the dam’s wall.     You and Dr. William Davis are two reachers that got me off, and kept me off, of statins many years ago. Thank you so very much. Life has been much nicer without the muscle pain and without the mental fog. It took me two years to fully shake the mental distractions I experienced after stopping my statin treatment. What a wake-up call.

    I wish you success in your case. Although I don’t know the specfics, I believe that sland and libel law varies greatly by nation. Here in the USA we theoretically lean to free speech, although Fox News would beg to differ given its big loss against Dominion. Also, on other contentious issues, Americans are free to speak (or write) their mind and not fear fines or prison, although it can (and sometimes does) incur damage to job, career, university attendance, social media use, banking services, and fair-weather friends and colleagues, etc. But fines and prison — very rare.

    This is a totally independent question from this article, but I haven’t been here in a while so decided to post it here anyway. I recently (end of June 2023) had a Vit D test done along with my regular bloodwork. I’m wondering what can be done for a condition they call hypercalciuria? I didn’t even take a urine test and doesn’t this have to do with a urine sample rather than a blood sample, and what should I do to lower this? My number was 58 out of a range of 20-50.

    Usually, during the winter months (I live where the sun barely ever shines in the winter) I take 10,000 IU of D3 and 1 K2 (150 mcg). Usually from about November to April I take that amount and then in April I lower it to 5,000 IU’s because we get much more sun and I try to be outside a lot. Any suggestions?

    Reading the judge’s very long preliminary ruling (156 paragraphs, 9575 words), it’s clear this is a very very complex case. This is one of the few paragraphs I understood:

    “C. In particular, the Claimants respond to the Defendants’ defences of honest opinion and truth by contending that an evaluation of the relevant scientific evidence relating to cholesterol, CVD and statins, primarily in the form of published scientific studies, demonstrates that the science on these issues is not in fact cut and dried as appears from both the articles complained of in the Defence (and could not reasonably be considered to be cut and dried), and that all the published statements that the Claimants have made on these topics which are not the same as the ones that the Defendants have imputed to them in the publications they have made honestly and reasonably on an evidence-based basis… ”

I have permanent spinal myelin damage from 80mg of atorvastatin. I quit after 6 months on my own. If I had continued taking them like my dr. said I’d have to, I’m convinced I’d be dead now.     I am thinking of both of you during this stressful time.
    I continue to support both of you. Having suffered crippling symptoms, I was driven to find out the cause of my deteriorating health issues 10 years ago. I came across articles by both of you and I remain convinced that statins were the cause of my distress. In the years since, I have had many discussions with medics consistently advising me to reconsider my stance against statins, but I will never, ever use them again.

    Wish you all the success with the case. I had just been to my fathers GP with him. He was suffering a whole pile of side effects, all of which were listed on the statin Insert papers.
    His GP said “ah ignore them, I wish they didn’t print those product inserts and we could simply give you pills in plain brown bottles like we used to do….”

    Let us hope that the proceedings will be fair and the Judges concerned will evaluate evidence openly and without bias. However, I suspect the lawyers of the Pharma companies are beavering away on all sorts of ways to ensure their masters aren’t inconvenienced by being shown to be less than honourable.     As one who suffered from Simvastatin and benefitted from your book that encouraged me to abandon statins for good (ten years ago), I’ll be extremely interested in your court case.

    I went for a 14 mile bike ride into the Penniness today, and I very much doubt if I could have done that if I were still taking statins!

    Having had to plead a case 10 years ago in the Royal Courts of Justice without using a lawyer, I’d say it’s quite a daunting experience, not least because of its impressive location. It’s crucial to thoroughly prepare every aspect of your case and research as to its correct format. Our case was not about defamation (though it could have been in part) but was to prevent a venal ex girlfriend of my son (severely brain-damaged after a cardiac arrest) from obtaining jurisdiction over him and his finances. We won our case and were congratulated by the judge on how assiduously we’d prepared it. Coincidentally, I’m currently trying to persuade his doctor to take him off statins, which she’s loathe to do on the grounds that his cardiac arrest signified problems with his heart!

    Litigation is incredibly time consuming, time you will never get back, considerable stress is suffered, not good for the ticker, and then the bills come in. Your foe has very deep pockets for the most slippery barristers. I would have advised you ignored it. I now advise you do a bit of research and see what they did to the great historian David Irving when he objected to being libelled.

    Libel is a very contentious area of the law where there will be no jury. And remember you are not just up against the Mail On Sunday but big pharma with even bigger pockets to fund so called ‘expert’ evidence.

    I am sorry not to be more supportive and encouraging, but forewarned is forearmed. I do not wish you luck, I wish you justice.

    If there is any justice and no big Pharma payoffs you should win with ease. Anecdotal on thyroid uk and just from my front facing role I know many people are deleteriously affected and continue to be affected because such is the brain washing the medical profession has undergone even with presented with a patient with overt side effects they are unable to recognise and attribute the cause.

    So many of our medical professionals are suffering from a case of terminal cognitive dissonance.
